1. Acknowledgment

Welcome to ailandscapedesign.top ("the Website", "We", "Us", or "Our"). These Terms and Conditions ("Terms") govern your access to and use of our online services, including any AI-generated landscape design tools and related products (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

2. Definitions

Country: China (interpreted in accordance with applicable international law where required)

AI-generated Content: any image, design, or output automatically created through our AI systems.

Prohibited activities include, but are not limited to:

  • Uploading or distributing unlawful, defamatory, or infringing content.
  • Using AI-generated content for misleading, harmful, or deceptive purposes.
  • Attempting to interfere with, hack, or reverse-engineer any part of the Service.

5. Intellectual Property

All content, features, and functionality of the Service — including AI models, algorithms, website design, and interface — are owned by or licensed to the Company.

AI-Generated Content

  • Users may use AI-generated designs for personal or non-commercial purposes unless otherwise authorized in writing.
  • The Company does not transfer intellectual property ownership of AI-generated outputs.
  • AI-generated results may be inspired by existing datasets and do not guarantee originality or exclusivity.

6. User Content

You retain ownership of any content you upload but grant the Company a non-exclusive, worldwide, royalty-free license to store, process, and display it for the operation and improvement of the Service.

You represent and warrant that any content you upload does not infringe on the rights of any third party.

7. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Service, including reliance on AI-generated content.

If you paid for any part of the Service, the Company's total liability shall not exceed the amount you actually paid or USD 100, whichever is lower.

8. "AS IS" Disclaimer

The Service and all AI-generated outputs are provided "as is" and "as available", without any warranties of any kind, express or implied.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free;
  • Any defects will be corrected;
  • The Service will meet your expectations or intended results; or
  • Any content, data, or materials provided are accurate, reliable, or complete.

AI-generated designs are provided for informational and creative purposes only and do not constitute professional landscape design advice.

9. Links to Third-Party Websites

Our Service may contain links to third-party websites or services not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party websites. Accessing third-party links is at your own risk.

10. Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or misuse the Service. Upon termination, your right to use the Service will cease immediately.

The Company may also terminate inactive or fraudulent accounts at its discretion.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.

In case of any dispute, both parties shall first attempt to resolve the issue amicably. If unresolved within 30 days, either party may submit the dispute to the People's Court in Guangzhou, China for resolution.

12. Changes to These Terms

We reserve the right to modify or update these Terms at any time. If a change is material, we will provide notice (for example, via email or a website announcement) at least 30 days before the new terms take effect.

By continuing to use the Service after updates become effective, you agree to be bound by the revised Terms.

13. Translation and Precedence

If these Terms are translated into other languages, the English version shall prevail in case of any inconsistency.
